Penalty for Trespassing

Protecting your home or company from illegal entry should be a top priority. Nowadays, there are plenty of thieves, burglars, and vandals, which cause damage to properties. As such, if authorities catch an intruder in your property, this gives you the right to sue the person in court.

This crime is called trespassing, which basically means intruding onto someone else's property without permission. Generally, the criminal faces tort liability or other charges, depending on the scale of the offence. In the case of vacant land, if you posted a notice, anyone caught breaching this protocol will be prosecuted with civil liability only. If there are significant grounds for aggravated trespassing, the intruder may possibly face other charges. Basically, penalties are higher if the intruder is guilty of a criminal motive.

Believe it or not, this crime is not only applicable to humans but also domesticated animals, wherein the blame falls on the owner of the pet. For instance, a dog or cow straying into your land can be sued for animal trespassing. This is mainly considered a civil offence and the pet owner usually pays a fine. Additionally, when an object is placed onto your property without your permission, it is considered illegal.

Nowadays, the majority of the UK no longer considers this offence as a criminal act, except when there is proof of statutory enactment, such as forcible entry or being on dangerous or unauthorised grounds.

Surprisingly, this crime can also be used to describe assault and battery. The guilty party faces tort actions and other criminal charges. In these situations, there are tort actions you can take against the offender.

Aside from structures, you can also use this for secured network systems in computers. For instance, if a hacker gained unwanted access to your main frame, you can sue this person and he or she is sanctioned for a punishable tort.
